The following is a legal agreement between you (“purchaser”) and the owner of PhoenixDesigns and PhoenixPhotographyCS which governs your use of all products purchased (including textures or graphics within the template sets, information, text, images, graphics, data or other materials, products, and services provided through http://phoenixdesigns.bigcartel.com/).
By making this purchase, you agree to be bound by the terms of this agreement automatically, without any other conditions or declarations.
All of my designs, textures, actions, and templates are registered and protected under US copyright law. You may not re-sell, rent, sublicense, give, distribute, or otherwise transfer them or claim them as your own. With your purchase you acknowledge that the ownership of any PhoenixDesigns products do not get transferred to you. You may use them for personal or commercial purposes, but may not hand out or sell a layered file with PhoenixDesigns actions, templates, or designs unflattened. You also may not install the products on or transfer them to any computer not owned by you, the purchaser, nor allow others the right to use the products. Modifying or superficially altering the products and then reselling or redistributing them as your own is also prohibited.
You acknowledge that all products are non-refundable and not returnable, under any circumstances.
PhoenixDesigns does not offer a warranty for any products. Please make sure you have appropriate software to use the products. If you are unsure whether the products will work with your software or not, you can download the offered Freebies and try them out before your purchase. PhoenixDesigns does not warrant that the products will meet your requirements, or that their use will be uninterrupted or error free. PhoenixDesigns shall not be liable to any loss of profits or damage to you or any other person or entity arising out of the use of the purchased products. It is the purchaser’s responsibility to make sure all products are correctly prepared for printing and error free.
